What Makes a NY POA Valid Under the 2021 Law

New York’s Statutory Short Form Power of Attorney is governed by GOL §5-1513, as substantially amended on June 13, 2021. To be enforceable:

Requirement Detail
Execution Signed, initialed, and dated by the principal
Notarization Acknowledged before a notary (same standard as a real-property conveyance)
Two witnesses Both must be disinterested; the notary may serve as one; the named agent may not serve as either
Durability Durable by default — remains effective upon incapacity unless the document expressly states otherwise
Gift authority Agent may make gifts up to $5,000 aggregate per year without a special modification; larger gifts or gifts to the agent require an express grant in the Modifications section (the separate Gifts Rider was eliminated in 2021)
Safe harbor Third parties — including banks — that accept a substantially conforming form in good faith receive statutory protection, which is why well-drafted POAs are now honored far more reliably

A durable POA takes effect immediately and survives incapacity. A springing POA activates only on a stated future event — but proving that event can delay access when your family needs it most. And neither covers medical decisions: for those, you need a separate Health Care Proxy.

The Cost of Waiting

Without a valid POA, no one — not a spouse, not an adult child — has automatic legal authority over a parent’s finances. The alternative is Article 81 guardianship, a supervised court process. A durable POA signed today closes that gap permanently.
